Terms of Service

1. Acceptance of Terms

By creating an account or using Plateable ("Service"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the Service. These Terms constitute a binding agreement between you and Plateable ("we," "us," "our").

2. Description of Service

Plateable is an AI-powered food photo enhancement platform. We use artificial intelligence to improve the visual quality of food photographs submitted by users. Enhanced images are delivered digitally and are subject to availability of third-party AI processing services.

3. Accounts and Eligibility

You must be at least 18 years old and capable of forming a legally binding contract to use this Service. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You agree to notify us immediately of any unauthorized use.

4. Credits and Subscriptions

The Service operates on a credit-based system. Credits are consumed when you submit a photo for enhancement. The following terms apply to all purchases:

  • Monthly subscriptions grant a fixed number of credits each billing cycle. Unused credits do not roll over to the next cycle and expire at the end of each billing period.
  • Credit top-ups are one-time purchases of additional credits. Top-up credits do not expire and remain in your account until used.
  • All sales are final. We do not offer cash refunds on credits or subscriptions. If an enhancement result is incorrect or clearly defective, use the Report button on the photo in your history. We review all reports and, at our sole discretion, may return the credit to your account.
  • Plan upgrades. When upgrading your plan mid-cycle, you will be charged a prorated amount for the remainder of the current billing period. Existing credits from the lower plan are replaced with the full allotment of the higher plan.
  • Cancellation. You may cancel your subscription at any time. Access continues until the end of your current billing period. No partial refunds are issued for the remaining period.

5. Chargebacks and Disputes

We take payment disputes seriously. Before initiating a chargeback with your bank or card issuer, you must contact us and allow us 5 business days to resolve the issue.

Initiating a chargeback without contacting us first may result in immediate account suspension. We maintain detailed records of all service delivery, credit usage, and billing events. In the event of a dispute, we will provide this documentation to your card issuer. Fraudulent chargebacks for services that were delivered may be reported to relevant fraud prevention services.

6. Acceptable Use

You agree not to use the Service to:

  • Upload images containing illegal, harmful, or offensive content
  • Upload images depicting people without their consent
  • Attempt to reverse-engineer, scrape, or abuse our AI systems
  • Resell or redistribute the Service without written permission
  • Use automated tools to consume credits in bulk without genuine use
  • Violate any applicable local, national, or international law

We reserve the right to suspend or terminate accounts that violate these terms without refund.

7. Intellectual Property

You retain ownership of all images you upload. By submitting images, you grant Plateable a limited, non-exclusive license to process and enhance those images solely for the purpose of delivering the Service to you.

Enhanced images produced by the Service are yours to use commercially. We claim no ownership over your input or output images. You are responsible for ensuring you have the right to upload and use any images you submit.

8. Service Availability and Accuracy

We strive for high availability but do not guarantee uninterrupted service. AI enhancement results are not guaranteed to meet any specific standard of quality — results vary based on input photo quality, subject matter, and the inherent variability of AI systems. We are not liable for results that do not meet your expectations.

9. Limitation of Liability

To the maximum extent permitted by law, Plateable shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, revenue, or data, arising from your use of the Service. Our total liability to you shall not exceed the amount you paid us in the 12 months preceding the claim.

10. Modifications

We may update these Terms at any time. Continued use of the Service after changes are posted constitutes acceptance of the new Terms. We will notify users of material changes via email.

11. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. Any disputes shall be resolved through binding arbitration under the rules of the American Arbitration Association.
